U.S. Immigration and Customs Enforcement (ICE) has informed the Town of Herndon that it is not renewing the town’s Memorandum of Agreement authorizing participation in the federal 287(g) program, and therefore the program is no longer in effect.
ICE has discontinued the program nationwide, primarily due to federal budget restrictions.  The Secure Communities program, which helps identify criminal aliens as they are arrested and booked into custody, remains in effect at detention centers nationwide.  The Fairfax Detention Center, which houses arrestees from the Town of Herndon, participates in the Secure Communities Program.

The federal 287(g) program enabled local law enforcement personnel to question and detain individuals identified as criminal illegal aliens, for potential removal from the United States.  The Town of Herndon had participated in the program since 2007.

“Although the formal 287(g) program has been discontinued, we have over the course of the program developed strong relationships with ICE officials and we will continue to work closely with them to enhance public safety throughout our community,” said Col. Maggie A. DeBoard, Herndon’s Chief of Police.
